Just like when hiring a potential employee, a business owner should always interview a prospective attorney before beginning an ongoing relationship.
Wade Richardson, an attorney with RichardsonClement PC says, “When you sit down with your prospective attorney, you should be prepared to describe your business and potential legal needs.” That’s because the attorney may have some insight or suggestions the business owner hasn’t considered. Richardson offers these tips on the types of questions to ask a prospective business attorney:
• Does the attorney have experience helping similar businesses or addressing similar problems?
• Is the attorney willing to understand the business, it’s goals, and the vision for the future?
• Does the attorney communicate in a language that’s easy to understand? Do they take time to explain legal issues and terms?
• Does the attorney seem trustworthy and relatable?
• Has the attorney been recognized by his/ her peers?

Richardson says business owners should find out if the attorney is “AV Rated”? This is the highest rating an attorney can receive from his peers. Also is the lawyer recognized in “Best Lawyers”? “Although certainly not the sole basis for selection of an attorney, it is one of many considerations you should look for to ensure a minimum level of legal competence,” Richardson says.

Business owners should be mindful they are not hiring a law firm, but an individual attorney. The attorney- client relationship is a personal relationship. The business owner should feel like the attorney is one they are comfortable with and can have confidence in their advice.

Finally, never be afraid to ask for references. Good attorneys should be able to refer a business owner to any number of prior or existing business clients who can attest to their level of satisfaction with the lawyer’s services.
